    What does this Privacy Policy cover?

  • This Privacy Policy (the “Policy”) covers our treatment of your personal information that we gather when you are accessing or using our websites or services or when you contact us in any manner. We gather various types of information, including information that identifies you as an individual (“Personal Information”).

    Personal data we collect:

  • The types of personal data that we request from you and the ways that we process it are determined by the requirements of the country in which the position is located, and not the country in which you reside. Should you apply to more than one location or should the role to which you apply be available in more than one country, the types of personal data we request from you and the ways that we process it are determined by the requirements of all the countries in which the position is located.

  • We usually collect personal data directly from you when you apply for a role with us, such as your name, address, contact information, photographs and videos, work and educational history, achievements, and test results. We collect similar personal data about you from third parties, such as professional recruiting firms, your references, prior employers, Stack Rank employees with whom you have interviewed, and employment background check providers, to the extent this is permitted by applicable law. We may also collect personal data about you online to the extent that you have made this information publicly available. For example, we may find your profile on professional social media websites (such as LinkedIn) and contact you about suitable roles.

  • We do not seek to obtain and will not collect such data about a candidate unless permitted to do so by applicable laws.

    How do we use the information?

  • The information you provide to us is used by us to:

  • (a) provide our recruitment services to you, whether you are a client, candidate or a user of our website;

  • (b) enable you to submit your CV generally, to apply for specific jobs or to subscribe to our Job Alerts;

  • (c) provide information on suitable job opportunities to people who register with us, to match your profile with suitable job vacancies and to assist us in finding a position that is most suitable for you including the evaluation of your data against vacancies which we may have that we determine may be suitable for you;

  • (d) answer your enquiry;

  • (e) provide other services related to or supplementary to the above; services directly to your professional or business email address; and

  • (f) where we have a bona fide requirement by law to disclose it to third parties in relation to the detection of crime, the collection of taxes or duties, in order to comply with any applicable law and court order.

  • This list is not exhaustive and we may seek to process, use or disclose your information for any other purpose which has not been listed above always with your explicit consent. The more information we have about you the more bespoke we can make our service.

  • Where appropriate, we will seek your consent to undertake some of these activities.

  • We may also use the information you send to us via the websites and/or services, to communicate with you via email and, possibly, other means, if this is in accordance with your marketing preferences. However, you will always be able to opt-out of such communications at any time (see the “Your Rights” section below).

  • We will delete candidate personal data from our systems if we have not had any meaningful contact with you for seven years (or for such longer period as we believe, in good faith, that the law or relevant regulators require us to preserve your data). After this period, it is likely your data will no longer be relevant for the purposes for which it was collected.

    Data Retention

  • We will consider there to be meaningful contact with you if you submit your updated CV onto our website, apply for jobs with us or we receive an updated CV from a job board. We will also consider it meaningful contact if you communicate with us about potential roles, either by verbal or written communication or engage with any of our marketing communications.

  • Under new data protection regulations (GDPR), we are required to keep the data we hold accurate and, where necessary, up to date. As such, we will make an effort to regularly communicate with you to ensure your data is up to date and accurate.

  • Whilst we will endeavor to permanently erase your personal data once it reaches the end of its retention period or where we receive a valid request from you to do so, some of your data may still exist within an archive system. While certain details may still exist on an archive system, this cannot be readily accessed by any of our operational systems, processes or staff.

    Legal Basis for Processing

  • Our legal basis for the processing of personal data is our legitimate business interests, described in more detail below, although we will also rely on contract, legal obligation and consent for specific uses of data.

  • We will rely on contract if we are negotiating or have entered into a placement agreement with you or your organization or any other contract to provide services to you or receive services from you or your organization.

  • We will rely on legal obligation if we are legally required to hold information on to you to fulfil our legal obligations.

  • We will, in some circumstances, rely on consent for particular uses of your data and you will be asked for your express consent, if legally required. Examples of when consent may be the lawful basis for processing include permission to introduce you to a client (if you are a candidate).

    Security

  • We have implemented generally accepted standards of technical and operational security to protect personal data from loss, misuse, alteration, or destruction. Only authorized personnel of Stack Rank and of our third-party service providers are provided access to personal data, and these employees and third party service providers are required to treat this information as confidential. Despite these precautions, we cannot guarantee that unauthorized persons will not obtain access to your personal data.

    Job Alerts

  • To subscribe to job alerts emails, you will be required to provide your e-mail address, which will be used for the purpose of keeping you informed, by e-mail, of the latest jobs in your nominated industry and/or industry news via job alerts.

  • Should you decide that you no longer wish to receive this information, unsubscribe links are provided in every job alert email that you receive.

  • Job alerts can also be received via RSS feeds without having to provide your email address.

    Your Rights:

  • We take reasonable steps that are designed to keep your personal data accurate, complete, and up-to-date for the purposes for which it is collected and used. We also have implemented measures that are designed to ensure that our processing of your personal data complies with this Privacy Notice and applicable law.

  • In accordance with applicable law, you may have;

  • A. a right to request a copy of the personal data we hold about you and details of how we use that information;

  • B. a right to amend or rectify your personal data if any of the information held about you is incorrect or out of date;

  • C. a right of portability of your personal data;

  • D. a right to erase your personal data, to demand that we cease the processing of your personal data, to restrict the processing of your personal data, and/or to withdraw your consent to the processing of your personal data. This may not apply if there are other legal justifications to continue processing and we may need to retain certain personal data where required or permitted under applicable law, and;

  • In addition, and where granted by applicable law, you may have the right to lodge a complaint with a competent data protection authority.

  • If you would like to make a request to access, review, correct, delete or port the personal data we have collected about you, or to discuss how we process your personal data.

  • To help protect your privacy and security, we will take reasonable steps to verify your identity before granting you access to your personal data. We will make reasonable attempts to promptly investigate, comply with, or otherwise respond to your requests as may be required by applicable law. Depending upon the circumstances and the request, we may not be permitted to provide access to personal data or otherwise fully comply with your request; for example, where producing your information may reveal the identity of someone else. We reserve the right to charge an appropriate fee for complying with your request where allowed by applicable law, and/or to deny your requests where, in the Firm’s discretion, they may be unfounded, excessive, or otherwise unacceptable under applicable law.

    Social Media Tools

  • Our application process allows you to pull relevant information from social media websites (such as LinkedIn, Google Drive and Dropbox) into your application form. If you choose to feed any personal data from such social media tools, it will be used in accordance with this Privacy Notice.

    Marketing Consent

  • From time to time we would like to send you details of reports, promotions, offers, networking and client events and general information about the industry sectors which we think might be of interest to you. If you consent to us contacting you for marketing purposes.

    Changes to our Privacy Policy

  • This privacy policy may be changed by Stackrank Search Labs at any time. If we change our privacy policy in the future, we will set out those changes here and update the privacy policy modification date above, so that you will always know what personal information we gather, the purposes we might use it for and to whom we might disclose it. If we materially change this privacy policy in a way that affects how we use or disclose your personal data, we will provide a prominent notice of such changes and the effective date of the changes before making them.
